The Failure of the 28-Point Ceasefire Plan for Ukraine: How Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the tension caused by the announcement of a new comprehensive peace framework for resolving the conflict appeared – briefly – to have been stabilised. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of rocket attacks on Kyiv.

The Rhythm of Negotiation and Warfare

The sequence of conflicting incidents captured the bleak nature of the outgoing year. By day, diplomatic battles are conducted: positive announcements are issued from multiple capitals. Significant resources is expended on restraining specific proposals. By night, Moscow forcefully demonstrates the world that, for them, war remains the main instrument for achieving "settlement".

Nighttime Reality

As the offensive progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was exposed. Ukraine is capable of detecting rocket firings from across the border, a capacity afforded by timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to engage hostile guided weapons flew past – modern combat jets provided to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles targeted at a hostile projectile. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch shakes the surroundings, shaking the windows. The brief panic quickly becomes resigned acknowledgment: possibly the approaching threat won't strike its target this time, sparing the city from catastrophe and another blackout.

Continuous Dangers

Following this, a large-caliber weapon opened up on a drone in the vicinity, part of a mobile-fire group – almost certainly allied-provided weaponry. Unfortunately, the projectiles didn't strike the hostile drone – it continued its flight toward its target.

Periodically, this persisted until dawn. Kyiv awoke to the early updates: seven people killed, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still maintained normal activities – experiencing conflict. But those entire period illustrated Ukraine's essential dependence on Western support – a dependence that neighboring countries are clearly incapable to replace in the immediate future.

Failed Diplomacy

The detailed framework from American leadership sparked intense emotion, discussion and deep concern – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually win the battle. This trend will, no doubt, endure.

Political Considerations

It is convenient to criticize particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. Washington operates on a premise well known to experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The US administration assumes that it is unfeasible to force Russia to surrender the territory that it presently holds in Ukraine's south or east.

The challenge is that while accepting these circumstances, American administration does little to deter Moscow, through statements or actions, from assuming that the status quo will not shift further in its benefit in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its allies are coming close to fatigue. Their incentive to accept conditions that does not give them the maximum possible gain is almost completely absent. There may be multiple initiatives to end hostilities, but they will persist as long as Russia's leader remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still persist, progressively conceding lives and land but averting a complete military breakdown until situations evolve in its favour.

Present Conditions

Factually, there are no real preconditions for a armistice. Now, subjective factors are becoming relevant: personal goals to mediate resolution and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the national cause against any initiative Kyiv finds unworkable, so that their attention does not switch to homefront challenges. And although their objective will now be much harder after recent developments, it remains very improbable that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a mere seven days to terminate the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, recent disclosures, all achieved their purpose.

While new proposals based on established approaches are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and show certain reluctance to modify developments, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the foreseeable future, primarily depend on sustained allied backing.
